Terms of sale

Article 1 – Scope

These Terms of Sale apply, without restriction or reservation, to all sales made by Mattis Roussel, trading as Bireka ("the Seller", "we", "us"). They cover sales to consumers and non-business buyers ("the Customer", "you") who wish to buy the products offered for sale by the Seller ("the Products") on our website (the "Site").

They set out in particular the conditions for ordering, payment, delivery and handling any returns of Products ordered by Customers.

These Terms of Sale may be supplemented by specific conditions shown on the Site before any transaction with the Customer.

These Terms of Sale apply to the exclusion of all other conditions, in particular those applicable to sales in shops or through other distribution and sales channels.

They are available at all times on the Site and will, where applicable, prevail over any other version or conflicting document.

As these Terms of Sale may be amended from time to time, the version that applies to your purchase is the one in force on the Site on the date you place your order.

Article 2 – Products offered for sale

The Products offered for sale on the Site are:

  • turntables (record players);
  • turntable accessories (speakers, cleaning and care products).

The main characteristics of the Products, including specifications, illustrations and dimensions or capacity, are shown on the Site. Please read them before placing an order. The choice and purchase of a Product is your responsibility.

We make every effort to ensure that the photographs and graphics on the Site accurately represent the Products. Slight differences, particularly in colour, may occur depending on your screen settings. This does not affect your right to receive Products that match their description.

Please refer to each Product's description for its properties, essential features and delivery times.

Contractual information is provided in English and is confirmed no later than when you confirm your order.

Article 3 – Validity of offers

Offers are valid while stocks last, as indicated when you place your order.

Article 4 – Seller's contact details

Under the UK GDPR and the Data Protection Act 2018, you have the right to access, rectify, object to, erase and port your personal data at any time. To exercise these rights, simply email contact@bireka.com. Further details are available in our Privacy Policy.

By confirming your order, you accept these Terms of Sale without restriction or reservation.

You confirm that you are at least 18 years old and have the legal capacity to enter into a contract and buy the Products offered on the Site.

Article 5 – Orders

5.1 Placing an order

You select the Products you wish to order on the Site. Before confirming your order, you can check its details and total price and correct any errors. It is your responsibility to check that your order is accurate and to report or correct any error immediately.

Your order is registered on the Site when you confirm it. By confirming it, you accept these Terms of Sale in full, together with the Site's Terms and Conditions.

The sale only becomes final once we have sent you an email confirming that we have accepted your order. This email is sent without delay, once full payment has been received.

Any order placed and confirmed by you and accepted by us as described above forms a distance contract between you and the Seller.

Unless proven otherwise, the data recorded in our computer system constitutes proof of all transactions concluded with you.

We reserve the right to cancel or refuse any order from a Customer with whom there is a dispute about payment for a previous order.

You can follow the progress of your order using the tracking link we send you by email.

We do not sell Products to businesses through the Site, only to consumers and non-business buyers for their personal needs. We therefore reserve the right to refuse orders for large quantities of the same Product (more than 5 items).

5.2 Changing your order

We can only accept changes to your order where possible. You must email them to contact@bireka.com at least 1 day before the scheduled dispatch date.

If we cannot accept the requested changes, any amount you have paid will be refunded within 14 days of our telling you so, unless you would prefer a credit note or an exchange.

5.3 Cancelling your order

In addition to your right to cancel (Article 10) and to cases of events outside our control (Article 14), you may cancel your order free of charge at least 1 day before the scheduled dispatch date.

Article 6 – Prices

Products are supplied at the prices shown on the Site when your order is registered. Prices are shown in pounds sterling (GBP) and include VAT.

Prices take into account any discounts offered on the Site.

Prices are fixed during their period of validity, as shown on the Site. Outside that period, we may change prices at any time. Prices include handling, shipping, transport and delivery charges.

The amount you pay is the total purchase price, including these charges.

Article 7 – Payment

The price is payable in full on the day you place your order, by secure payment, using:

  • debit or credit card: Visa, Mastercard, American Express;
  • Apple Pay, PayPal or Klarna.

Card payments are irrevocable, except in the event of fraudulent use of the card. In that case, you may ask for the payment to be cancelled and the amount refunded.

Article 8 – Delivery

Products are delivered to addresses in the United Kingdom.

The delivery time is the dispatch time shown on the Product page plus processing and transit time. Products are delivered within an average of 5 to 8 working days to the address you gave when ordering.

Delivery takes place when you, or someone you have nominated, take physical possession of the Product. Unless there are special circumstances or one or more Products are unavailable, your order will be delivered in a single shipment.

We will do our best to deliver your order within the times stated above. If we fail to deliver within the agreed period, you may give us a reasonable new deadline. If we miss that deadline as well, or if delivery within the original period was essential, you may cancel the contract. We will then refund all sums paid within 14 days, without any deduction. If no delivery period was agreed, we must deliver within 30 days of the contract being made (Consumer Rights Act 2015, section 28).

If a Product you receive does not conform to your order, we will put it right or refund you, as set out in Article 11.

We bear the risks of transport and will replace or refund any Product damaged in transit.

Article 9 – Transfer of ownership and risk

Ownership of the Products passes to you only once you have paid the price in full, whatever the delivery date.

Whatever the date ownership passes, the risk of loss or damage to the Products only passes to you when you take physical possession of them. The Products therefore travel at our risk.

Article 10 – Right to cancel

You have 14 days from the day you receive the Product to cancel your purchase, without giving any reason and without paying any penalty. If your order is delivered in several parcels, the period runs from the day you receive the last item.

To exercise this right, send us a clear statement of your decision to cancel, for example by email to contact@bireka.com. You can use the model cancellation form in Annex 2, but you don't have to. If you use an online cancellation form, we will send you an acknowledgement of receipt on a durable medium (for example by email) without delay.

You must return the Products no later than 14 days after telling us that you wish to cancel.

Please return the Products complete, with all accessories and the instruction manual, ideally in their original packaging, together with your order number. You may handle the Products as you would in a shop to check their nature, characteristics and how they work. If a Product has been handled beyond this (for example scratched, damaged or incomplete), we may reduce your refund to reflect the loss in value.

If you cancel, we will refund the price of the Product(s) and the original standard delivery charges. Return costs are at your expense.

We will issue your refund within 14 days of receiving the Products back, or of receiving proof that you have sent them, whichever is earlier. The refund will be made using your original payment method.

Full details are available in our Returns & Refunds Policy.

Article 11 – Seller's liability – Statutory rights

The Products sold on the Site are designed for domestic, non-professional use.

Independently of your right to cancel, and at no extra cost to you, the Products benefit from your statutory rights under the Consumer Rights Act 2015. Products must be:

  • of satisfactory quality;
  • fit for purpose;
  • as described and matching any sample or model shown.

If a Product is faulty, damaged or does not match your order:

  • within 30 days of delivery, you can reject it and receive a full refund;
  • after 30 days, we will repair or replace it. If this is not possible or does not fix the problem, you are entitled to a price reduction or a refund;
  • within 6 months of delivery, a fault is presumed to have existed at delivery unless we can prove otherwise;
  • you can make a claim up to 6 years after delivery (5 years in Scotland).

We will refund the original delivery charges, and reimburse return costs for faulty or damaged Products on presentation of proof of postage.

Refunds for faulty or non-conforming Products will be made as soon as possible and no later than 14 days after we agree that you are entitled to one. The refund will be made using your original payment method.

These statutory rights do not cover damage caused by misuse, professional use, negligence or lack of maintenance on your part, normal wear and tear, or accidents.

Nothing in these Terms of Sale limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for breach of your statutory rights.

Article 12 – Personal data

The personal data we ask for is necessary to process your order and issue invoices. It may be shared with our partners responsible for fulfilling, processing, managing and paying for orders.

Information provided through the Site is processed in accordance with the UK GDPR and the Data Protection Act 2018.

You have the right to access, modify, rectify, object to, port and restrict the processing of your personal data at any time. You can exercise these rights as described in our Privacy Policy.

Article 13 – Intellectual property

The content of the Site is the property of the Seller and its partners and is protected by UK and international intellectual property laws. Any full or partial reproduction of this content is strictly prohibited and may constitute copyright or trade mark infringement and passing off.

Article 14 – Events outside our control

Neither party will be liable for any failure or delay in performing its obligations under these Terms of Sale caused by events outside its reasonable control. If such an event affects the delivery of your order, we will contact you as soon as possible. If there is a risk of substantial delay, you may cancel your order and receive a refund for any Products you have not received.

Article 15 – Governing law and language

These Terms of Sale, and any transactions arising from them, are governed by the laws of England and Wales. You can bring legal proceedings in the courts of England and Wales. If you live in Scotland, you can bring legal proceedings in either the Scottish or the English courts. If you live in Northern Ireland, you can bring legal proceedings in either the Northern Irish or the English courts.

These Terms of Sale are written in English.

Article 16 – Complaints and disputes

If you have a complaint, please contact us first at contact@bireka.com. We will do our best to resolve it quickly.

If we cannot resolve your complaint, we will tell you about an alternative dispute resolution (ADR) provider and whether we agree to use it. You can also get free, impartial advice from Citizens Advice (www.citizensadvice.org.uk).

Any dispute that cannot be resolved amicably will be brought before the competent courts, as set out in Article 15.

Article 17 – Pre-contractual information and acceptance

By placing an order on the Site, you fully accept these Terms of Sale and agree to pay for the Products ordered. These Terms of Sale prevail over any conflicting document.

Annex 1 – Summary of your key statutory rights

This is a summary of your key legal rights, which are subject to certain exceptions. For detailed information, please visit the Citizens Advice website (www.citizensadvice.org.uk).

  • up to 6 months: if your goods can't be repaired or replaced, you're entitled to a full refund in most cases;
  • up to 6 years (5 years in Scotland): if your goods do not last a reasonable length of time, you may be entitled to some money back.
